To the maximum extent permitted by applicable law, Hitravelor's total liability to you for any damages (regardless of the foundation for the action) shall not exceed in the aggregate the amount of fees actually paid by you to Hitravelor during the month immediately preceding the act allegedly giving rise to Hitravelor's liability.

The Services are provided on an ongoing basis, and are provided solely to:

• Assist users in gathering travel information, posting Content and searching for and booking travel services and reservations; and

• Assist travel, tourism and hospitality businesses in engaging with users and potential customers, by way of free and/or paid - for services offered by or through the Hitravelor Companies.

Products, services, information and Content on our Services change regularly, so that it is up to date (for example, with current information and offers). This means, for example, that in respect of third party services, new transportation services, accommodations, restaurants, tours, activities or experiences may become available for you to book whilst other services may become unavailable.

We may change or otherwise modify this Agreement in the future in accordance with the terms and conditions herein, and you understand and agree that your continued access or use of the Services after such change signifies your acceptance of the updated or modified Agreement. We will note the date that revisions were last made to this Agreement at the bottom of this Agreement, and any revisions will take effect upon posting. We will notify you of material changes to these terms and conditions by either sending a notice to the email address associated with your profile or by placing a notice on our websites. Be sure to return to this page periodically to review the most current version of this Agreement. If you don't want to accept any changes to this Agreement, you may close your account and cease to access the Services.

USE OF THE SERVICES

As a condition of your use of the Services, you agree that:

• all information supplied by you via the Services to the Hitravelor Companies is true, accurate, current and complete;

• you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you;

• you are 13 years of age or older. The Hitravelor Companies do not knowingly collect the information of anyone under the age of 13. If you are a consumer resident in the EU or the UK, we may deny you access to the Services if you violate this Agreement, or for any other reasonable cause. If you are not a consumer resident in the EU or the UK, we retain the right at our sole discretion to deny you access to the Services, at any time and for any reason, including, but not limited to, for violation of this Agreement. By using the Services, including any products or services that facilitate the sharing of Content to or from third party sites, you understand that you are solely responsible for any information that you share with the Hitravelor Companies. You may access the Services solely as intended through the provided functionality of the Services and as permitted under this Agreement.

Please note that there may be certain orders that we are unable to accept and must cancel. Hitravelor reserves the right, at sole discretion, to refuse or cancel any order for any reason.

Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department.

We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.

Both parties agree that after the order is sent, the service will be entirely provided by the third - party travel service company. At this stage, the full ownership of the product(s) belongs to the buyer; all relevant responsibilities and risks during the service process shall be borne by the buyer.

13. Transfer of Title

The ownership of the service products in your order will be transferred to you when the third - party travel service company and you sign an agreement. At that time, all product responsibilities and risks will also be transferred to you and the designated third - party company.

By placing an order on this website, you authorize Hitravelor to use third - party travel services on your behalf.

14. Typographical Errors

While Hitravelor strives to provide accurate product and pricing information, pricing or typographical errors may occur. Hitravelor cannot confirm the price of an item until after you order.

In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Hitravelor shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item.

15. Indemnity

You hereby indemnify Hitravelor and undertake to keep Hitravelor indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Hitravelor to a third party in settlement of a claim or dispute on the advice of Hitravelor's legal advisers) incurred or suffered by Hitravelor arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

16. Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen.

Any Party affected by Such events shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

17. Termination

You agree that we may, at any time and at our sole discretion, with or without cause or any notice to you, terminate your access to the Site. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection therewith.

If applicable law requires us to provide notice of termination or cancellation, we may give prior or subsequent notice by posting it on the Site or by sending a communication to any address (email or otherwise) that we have for you in our records.

18. Notice of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms.

19. Booking with third-party suppliers through Hitravelor

Use of Hitravelor Booking Services

The Hitravelor Companies offer you the ability to search for, select, and book travel reservations with third - party suppliers without leaving the Services.

Important: Hitravelor does not itself sell travel reservations. Hitravelor allows third parties to sell their travel reservations on Hitravelor.

Hitravelor may facilitate the promotion and sale of travel reservations by third parties to you. Hitravelor is not, however, the party that undertakes the promotion and/or sale. If you book a reservation with a third - party supplier, the contract for the reservation is always solely between you and the third - party. Hitravelor is not:

• the buyer or the seller of reservation;

• a party to the contract with the third - party or responsible for the fulfilment of that contract; or

• an agent of you or the third - party in connection with purchase or sale.

If you book a reservation with a third - party supplier, you agree to review and be bound by the supplier’s terms and conditions of purchase and website use, privacy policy and any other rules or policies related to the supplier’s site or property. Your interactions with third - party suppliers are at your own risk. The Hitravelor Companies will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any third - party suppliers or for any personal injuries, death, property damage or other damages or expenses resulting from your interactions with third - party suppliers.

Your rights of recourse in connection with a contract between you and a third - party supplier (for example, in relation to refunds and cancellations), will be between you and the third party as set out.
